Terms and Conditions of Use

There are two terms and conditions:

1. Terms and conditions for Parents and Young People signing up to the Register for Disabled Children and Young People.

2. Terms and conditions for FSD service record holders.

Terms and Conditions for Parents and Young People Signing up to the Register of Disabled Children and Young People

By registering with this website, you agree to these terms and conditions ("Terms").  Please read the Terms carefully as they set out your rights and obligation.  They also provide information on how you can submit material (“Content”) and how this will be used.

The register is a database of children and young people aged 0-25 living in Barnsley with a special educational need (SEN) or a disability.  It is entirely voluntary to register – plus you can add, change or remove your details at any time.

Your child does not have to be on the register to receive services or support from health or social care.  

Joining the Register will not affect any services or benefits that you currently receive; it will also not guarantee your child any additional services or benefits.

YOUR USERNAME AND PASSWORD

When you register, you will be asked to select a user name and password you can then use to access your account (“Account”) and log on to and/or participate in secure areas of the website.  You accept it is your sole responsibility to maintain the confidentiality of your password and you are responsible for all activity that occurs under this. You should make sure you are the only person using your password and you agree to notify us (Open Objects) of any unauthorised use of your password and any other breach of security as soon as you become aware of it.

What is it used for?

The register is important as it helps with planning and developing services for children and young people with SEN and disabilities.

The register is used to keep families updated so we can contact you with information that you may find of interest. This may include information on new groups; local services; SEND events; or how to respond to relevant public consultations.  We can also use the register to inform families when Barnsley is having a SEND inspection.  

We may also target information to you and your family.  For example, key transition periods in your child’s life – such as ‘preparing for adulthood’, where we can signpost you to relevant services or inform you of local disability information sessions linked to this issue.   

Those registering on-line, can also have the option to automatically generate a ‘Care Passport’ for you to download, which is a summary of your child’s needs, and any other appropriate information, such as carers contact details etc.  

How we will send you information

We will only send you news of services, events, as described above, it will not contain any of your personal details .  We will do this via email - in line with the customer service future council programme.   If you do not have access to an email address you will need to contact Barnsley Council’s Families Information Service - free phone 0800 0345 340 to discuss your registration and how you wish to receive news and information.  

What happens to the information?

Any information you provide is managed securely by Barnsley Council, Families Information Service.   We shall ask you to update this information at least once every two years, so we can keep you up to date as your child grows and develops.    We will do this by email, or in writing if you do not have access to an email account.  Therefore, please keep your record up to date with your current email/home address.

We will only share statistical data with health, Job Centre Plus and other key services (such as further education providers), to help them plan for services.  We will not give out any named or personal data.  

What happens if I no longer wish to be on the Register?

If you decide at a later date that you would like your details removed from the Register, if you do not have an online application it may take up to 30 days to remove your details.

Your Privacy

The information will be kept by Barnsley Council on a secure computer database under the terms of the Data Protection Act. The information you provide will only be seen by a small number of staff members in the Families Information Service manage and maintain the datastore.   

Terms and Conditions for FSD Service Record Holders

By registering with this website, you agree to these terms and conditions ("Terms").  Please read the Terms carefully as they set out your rights and obligation.  They also provide information on how you can submit material (“Content”) and how this will be used.

IF WE DISCOVER OR HAVE ANY REASON TO SUSPECT YOU HAVE BREACHED THE TERMS WE RESERVE THE RIGHT TO SUSPEND OR TERMINATE YOUR ACCOUNT IMMEDIATELY AND WITHOUT NOTICE.

1. YOUR USERNAME AND PASSWORD

2. YOUR CONTENT:

You agree and confirm that:

A. all Content submitted by you is accurate, true and up to date and, if your Content contains opinions, these are your own and genuinely and truly held by you;

B: all Content submitted by you may be used on this website in any way required.  Content may be rejected, edited, moderated, removed or deleted at our absolute discretion.

C. all Content is original to you and you are fully entitled (and have all necessary consents) to submit the Content (you must also have the consent of anyone featured in the Content to provide this to us) and you are happy for this to be used as set out in the Terms;

D. nothing in the Content will infringe the copyright or any other right of any person, breach any contract or duty of confidence, be defamatory, obscene, offensive, indecent, harassing, threatening, breach anyone’s privacy or may constitute a contempt of court or be calculated to bring any person into disrepute;

3. YOUR PERSONAL DATA

Personal information you are asked to supply on your registration form ("Your Personal  Data"), will be used as follows: (i) to administer your registration and Account; (ii) in making decisions about whether Content you submit should be accepted, rejected or used.   Your Personal Data will be kept private and confidential, and will not be passed on to third parties without your express consent and will be used in accordance with Barnsley Council's Privacy Policy.

4.  OTHER

If you become aware of any misuse of the Content or wish to complain about any Content on this website or believe any of your rights have been violated, you can notify Barnsley Council - Families information Service via the website contact details.

You may terminate your Account at any time, for any reason, by following the instructions within your account pages. Even after your Account is terminated (for whatever reason) the Terms will remain in full force and effect.   We reserve the right to suspend or terminate your Account or access to any part of the website at any time if you breach the Terms or for technical reasons.

The Terms shall be governed by and construed in accordance with the laws of England. Any disputes arising from this website or Terms will be decided only by the English courts.
